Terms of Service

Welcome to HourVault. By accessing our website and purchasing our luxury timepieces, you agree to comply with and be bound by the following Terms of Service. If you disagree with any part of these terms, please do not use our website or services.

You must be at least 18 years old to purchase from HourVault.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under applicable law that cannot lawfully be excluded.


1. Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded.

Our goods come with guarantees that cannot be excluded under the ACL, including that they are:

  • Of acceptable quality;
  • Fit for the purpose for which goods of that kind are commonly supplied; and
  • Consistent with any express descriptions or representations made by HourVault.

If a product experiences a major failure, you are entitled to:

  • A replacement or refund; and
  • Compensation for any other reasonably foreseeable loss or damage.

If a product fails to meet an applicable consumer guarantee but the failure does not amount to a major failure, you are entitled to have the product repaired or replaced.


2. Purchases and Payment

All purchases are subject to product availability.

  • All prices are displayed in Australian Dollars (AUD).
  • Prices include GST unless otherwise stated.
  • The price displayed at the time you successfully place and pay for an order will be honoured for that order, even if our listed prices change later.
  • We reserve the right to update prices for future orders at any time.

Order Acceptance

HourVault may decline to accept or cancel an order in limited circumstances, including where:

  • A listed price or product description contains a genuine error;
  • The product is unavailable or has been discontinued;
  • We reasonably suspect fraud or unlawful activity;
  • We are unable to verify your identity for a high-value purchase.

If we cancel an order after payment has been received, we will:

  • Notify you promptly; and
  • Issue a full refund using your original payment method.

Where we suspend or close your account for reasons other than fraud, unlawful conduct, or breach of these Terms, we will provide reasonable notice where practicable.


3. Shipping & Delivery

HourVault uses a tiered shipping model based on the declared value of your purchase. Shipping costs are disclosed before checkout.

All shipments include:

  • Fully insured shipping;
  • Secure packaging;
  • Tracking information; and
  • Signature required upon delivery.

Delivery Time

We aim to deliver orders within 3–7 business days after dispatch, depending on destination.

Delivery times are estimates only and are not guaranteed.

HourVault is not responsible for delays caused by events beyond our reasonable control, including:

  • Courier disruptions;
  • Customs processing;
  • Severe weather; or
  • Other unforeseen transport delays.

Where delays occur, we will keep you informed and work with you toward a reasonable resolution.


4. Returns and Refunds

In addition to your rights under Section 1 (Consumer Guarantees), HourVault does not accept change-of-mind returns.

This policy does not limit or exclude any rights you have under the Australian Consumer Law.

Please refer to our separate refund or warranty policies where applicable.


5. Limitation of Liability

To the maximum extent permitted by law, and subject to the consumer guarantees outlined in Section 1, HourVault is not liable for any:

  • Indirect loss;
  • Incidental loss;
  • Special damages; or
  • Consequential damages,

arising from your use of, or inability to use:

  • Our website;
  • Our products; or
  • Our services.

Nothing in this section limits your rights under:

  • The Australian Consumer Law; or
  • HourVault’s Warranty Policy.

6. Acceptable Use

When using our website, you agree not to:

  • Engage in fraudulent or unlawful conduct;
  • Attempt to gain unauthorised access to our systems;
  • Interfere with or disrupt the operation or security of the website;
  • Infringe the intellectual property or legal rights of others.

You are responsible for:

  • Maintaining the confidentiality of your account credentials; and
  • All activity that occurs under your account.

7. Intellectual Property

Unless otherwise stated, all content available on the HourVault website—including:

  • Text;
  • Graphics;
  • Logos;
  • Images;
  • Software;
  • Website design; and
  • Other materials,

is owned by HourVault or its licensors and is protected under applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, publish, or commercially exploit any website content without our prior written permission.


8. Complaints and Dispute Resolution

If you have a concern regarding your purchase or our services, please contact us first at:

We will make reasonable efforts to resolve your concern directly.

If a dispute cannot be resolved through discussion, either party may refer the matter to mediation before commencing court proceedings, except where urgent legal relief is required.

You may also seek assistance from:

  • The Australian Competition and Consumer Commission (ACCC);
  • NSW Fair Trading; or
  • Your relevant State or Territory consumer protection agency.

9. Changes to These Terms

HourVault may update these Terms of Service from time to time.

Any updated version will become effective for orders placed after the revised Terms are published on our website.

The current effective date will always appear at the top of this document.


10. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.


11. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Subject to any rights you have under the Australian Consumer Law to commence proceedings in your local court where applicable, any dispute relating to these Terms is subject to the non-exclusive jurisdiction of the courts of New South Wales.
